These Terms of Use (hereinafter “these Terms”) set forth the conditions of use of HealthExport (hereinafter “the App”) provided by Koji Torishima (hereinafter “the Company”). Anyone who uses the App (hereinafter “the user”) must agree to and abide by these Terms. If you do not agree to these Terms, you must cease downloading, installing, and using the App. By downloading, installing, or using the App, the user is deemed to have agreed to these Terms.
Article 1. Responsibilities and Rights of Users
1. Users shall use the App at their own risk, and agree to be responsible for any and all acts that violate their obligations under these Terms, any and all acts performed using the App, and any damages (including damages the Company may incur) resulting from such acts.
2. The user’s right of use is non-exclusive and may not be sublicensed to a third party, transferred, or succeeded to under the contractual status.
3. The equipment (including smartphones and tablets), network, and other environment for running the App shall be prepared at the user’s expense and responsibility.

The App is free to use.
2. About Targeted Ad Serving
The Company uses IDFA to display behavioral targeting advertisements and provides it to the following third parties. IDFA will not be used to identify you. Health data obtained from HealthKit is never used for ad serving.

Article 3. About the Features
1. The App reads HealthKit health data authorized by the user and exports it to a CSV / XML file.
2. Reading is limited to the scope the user has authorized, and the user chooses where the exported file is shared. For details on the handling of health data, see the Privacy Policy.
3. The accuracy and completeness of exported data depend on the source data stored in HealthKit. The App is not intended for medical or diagnostic use.
Article 4. Prohibitions
In using the App, users shall not engage in any of the following acts. In addition, if any damage is caused to the Company or a third party as a result of the user’s violation, the user shall be liable for compensation for such damage.
- Use of the App by any method other than that approved by the Company
- Acts that violate laws, regulations, or public order and morals
- Criminal acts
- Use of the App for commercial or for-profit purposes beyond the scope of personal use
- Any act that interferes with or hinders the operation of the App
- Use of the App by impersonating a third party
- Any act that infringes on the copyrights, patents, utility model rights, design rights, trademarks, know-how, or any other intellectual property rights of the Company or any third party
- Acts of providing direct or indirect benefits to antisocial forces in relation to the App
- Any other conduct that the Company deems inappropriate based on reasonable grounds
Article 5. Disclaimer
1. The Company does not guarantee the completeness, usefulness, guaranteed operation, fitness for a particular purpose, compatibility with the device used, or any other matters related to the App. In addition, the Company shall not be liable for any damages incurred by users or third parties due to communication failures, defects or failures in system equipment, or use of the App.
Article 6. Modification, Suspension, or Termination of the App
1. The Company may change the contents, display, method of operation, management, and other aspects of the App, or suspend or terminate the provision of the App, without prior notice to the user. In such cases, the Company shall not be liable for any events resulting from such changes or suspension.
2. If a user violates any of the provisions of these Terms, the Company may terminate these Terms with such user and terminate the user’s use of the App without any notice.
Article 7. Changes to these Terms
1. The Company may change these Terms without prior notice and without obtaining the prior consent of users when it deems necessary.
Article 8. Governing Law and Jurisdiction
1. These Terms shall be governed by the laws of Japan.
2. In the event that a dispute arises between the Company and a user in relation to these Terms or the App, the court having jurisdiction over the location of the Company’s head office shall have exclusive jurisdiction.
